The Tenant shall:
a. Keep the plot clean, in a good state of cultivation (75%) and fertility and in good condition and remove any rubbish. Do not hang washing out on plot, if live in adjoining house.
b. Not cause any nuisance or annoyance to other tenants/residents by having bonfires (not permitted) or obstruct any pathway with vehicles set out by the Council for the use of the tenants.
c. Not underlet assign or part with possession of the plot or any part of it.
d. Not without the written consent of the Council cut or prune any timber or other trees or take, sell or carry away any mineral gravel, sand or clay.
e. Not plant any trees (except soft fruit bushes) or hedge or erect any boundary fence/pathways on the plot.
f. Keep grass verges/pathways to and around the plot properly cut and trimmed and keep all ditches properly cleansed.
h. Not without the written consent of the Council erect any building or shed on the plot (no glass greenhouses permitted or glass of any type or bath tubs).
i. Not keep any animals, livestock or poultry on the plot (dogs must be kept on a lead at all times).
j. Not connect a hose to any water supply provided by the Council (only to fill a water butt).
k. Leave tools or personal belongings at the site, at their own risk.
l. Children must be supervised at all times and remain within the area of own plot, no childrens toys e.g. sandpits, pools, climbing frames – cultivation purposes only.
m. No vehicles to be left on site (cars/trailers).
n. Clearance of overgrown plots and rubbish will incur charges to the plot holder.
o. Not harass, intimidate or cause distress to other plot holders.
p. Not allow unaccompanied access to non plot holders.
Payment of rent: The rent of a plot shall, unless otherwise agreed in writing, be paid yearly and in full.
Power to inspect allotment plots: The Manager of Open Spaces and his assistant, or any Member of the appropriate Committee when directed by the Council shall be entitled at any time to enter and inspect an allotment plot.
Termination of a tenancy of an allotment plot: The tenancy of an allotment plot shall, unless otherwise agreed in writing, terminate on the next yearly rent day after receipt of notice in writing or the death of a tenant. It shall also terminate whenever the tenancy or right of occupation of the Council terminates.
The Council may also terminate it by re-entry after one month’s notice:
(i) if the rent is in arrears for not less than 14 days or
(ii) if the tenant is not duly observing the rules and general conditions of the tenancy. Plots will be cleared without notice and the plot holder charged an additional fee.
Exemption of contral lettings from these rules: These rules shall not apply to any land let to an Association or to any allotment plot which the Council or the appropriate Committee under special circumstances to be recorded in their minutes may exempt from these Rules. They also apply to allotments plots held under a tenancy made before these rules came into operation but not so as to affect any right to compensation for an improvement executed before these rules came into operation.
Service of notice: Any notice may be served on a tenant either personally or by leaving it as his last known place of abode or by registered letter addressed to him there or by fixing the same in some conspicuous manner on the allotment plot.
